SEVP Received Over 200 Comments on Employment-Related Draft Guidance

January 21, 2016

The Student and Exchange Visitor Program (SEVP) appreciates the time and effort put into the recent comments provided for the draft policy guidance related to F-1 student employment. This guidance was open for public comment from Aug. 14, 2015 until Sept. 28, 2015. During that comment period, SEVP received more than 200 comments.

While SEVP is unable to respond to commenters individually, the program will release a general response at a later date to the major themes of the comments received.

SEVP periodically requests comments from the public on draft and interim final guidance. Guidance is SEVP’s interpretation of federal laws and regulations that guide SEVP adjudicators in their decision-making. Study in the States describes the three types of guidance (draft, interim final and final) and how to comment.

SEVP thanks everyone who submits comments related to its policy guidance, as the feedback is constructive and helps the program address issues for future versions.

In addition to finalizing the previously mentioned employment-related guidance, stakeholders can also expect the program to release new and additional guidance this year on curricular practical training and optional practical training — pending the rulemaking — as well as on pathway programs.
