SEVP Accepting Public Feedback on Employment-Related Guidance

The Student and Exchange Visitor Program (SEVP) invites the public to comment on employment-related draft policy guidance until Monday, Sept. 28, 2015. 

During this designated feedback period, email your comments on the below draft guidance to SEVPFeedback@ice.dhs.gov with the title of the guidance in the subject line. The titles of the draft guidance open for public comment are:

    — F-1 and M-1 general employment
    — F-1 on-campus employment
    — F-1 off-campus employment.
    — F-1 emergent circumstances.
    — F-1 internship with an international organization

SEVP accepts public comments on draft guidance from individuals, regardless of affiliation, including individuals who are affiliated with SEVP-certified institutions, but who may not want to provide comments on behalf of their respective institution. While SEVP reviews and considers all comments when refining its guidance, it does not respond to specific individual comments submitted. 

Draft guidance is not official SEVP policy. Draft guidance is intended to ensure public understanding of how SEVP adjudicators apply decisions. Until published as interim final or final, the guidance is still in development and not official policy.

Guidance is also not the same as governing regulations. Each cabinet-level agency in the federal government develops governing regulations. SEVP develops draft, interim and final guidance to interpret how SEVP applies its governing regulations. Therefore, draft guidance seeks to clarify or revise SEVP’s policies on various topics affecting the adjudication process.
